Nike, Inc. is an “American multinational association” involved in the design, manufacturing, and marketing of athletic apparel and footwear. It employs more than 45,000 people and in 2020, reported $37.5 billion in revenue. In recent years, the brand alone was valued at $19 billion, making it the most valuable brand of comparable businesses. These figures alone do not meaningfully reflect Nike’s entrenched [1] presence in our culture. Nike is a brand that has defined coolness in athletic footwear partly by inking endorsement deals with high-profile athletes. Its logo, a simple check mark stitched on a pair of sneakers, provides instant reassurance and confidence.   In spite of this, Nike hasn’t always been as associated with positive emotions as its namesake [2], the Greek goddess of victory. In the 90s, the company was wading knee-deep in sweatshop and child labor scandals. Starting in 1991 all through the early 2000s, an activist movement against Nike happened at the backdrop of a wider grassroots movement. Initially resistant and reactionary, Nike gradually changed its organizational structure to proactively deal with its ethical missteps. Today, Nike is leading changes in the clothing and footwear industry notorious for labor issues– however, the transformation didn’t happen overnight.  Nike’s business model faces a backlashOn a winter day in 1964, Nike was founded as Blue Ribbon Sports by Phile Knight and Bill Bowerman. Their first shoe brand, Nike, was launched in 1972, which became the official name of the company in 1978.  In the 80s, Nike began global expansion. The company outsourced manufacturing to low-cost jurisdictions and instead invested heavily in design and marketing — which has been its business model ever since. Nike used its own production facilities at some points in time, but the general rule was that its main business concerns design and marketing.  During the initial years of expansion, Nike’s contractor facilities were in Korea and Taiwan. But after labor organized and prices rose in those countries, Nike moved to China, Vietnam, and Indonesia. Relying on cheap labor worked until the company’s publicity took a hit in the 90s by way of activism movements that sprang up [3] across the United States.  In 1991, Jeffrey Bellinger, a labor activist, sparked waves of criticism against Nike by reporting on their inhumane factory practices in Indonesia. Bellinger noted appalling conditions, likening them to those of a sweatshop (where people worked long hours under hazardous conditions). Nike first treated this criticism as a mere public-relations issue. A senior employee at the time expressed a prevailing sentiment by stating, “Nike has no responsibility for working conditions in its suppliers factories.” Although meaningful change was unlikely to happen, Nike released a code of conduct for supplier factories the following year, modeling it after Levis. Unsurprisingly, the code wasn’t enforced well in the absence of systematic monitoring; it also didn’t effectively address criticism as activism against Nike gained mainstream attention during the first half of the 90s.  In 1996, Life magazine ran a report on child labor with a photo of a Pakistani boy sewing a Nike soccer ball, titled Six Cents an Hour. Following the report and subsequent backlash, Nike began to implement a series of structural changes designed to monitor suppliers’ labor practices. From 1997 to 1998, the firm created a corporate responsibility department. It also hired journalist Andrew Young to review working conditions in its contractor factories.  Still, negative public sentiment persisted. Following the publishing of working condition reports by Andrew Young, public furor actually grew, as there were accusations of a perceived lack of transparency in the reports. In 1998, Nike was sued for misleading statements regarding its labor practices.  At the same time, a grassroots movement for factory disclosure was emerging on college campuses throughout the US. Students formed the Workers’ Rights Consortium (WRC) and demanded universities adopt a code of conduct and impose it on the suppliers of their branded apparel. As part of this procedure, schools affiliated with the WRC had to obtain a list of all the facilities used to produce university clothing. As Nike was supplying university branded apparel as well, it reluctantly disclosed its factories in 1999 to these schools but limited the disclosure to factories used for university clothing production… a comprehensive list of factories would only come several years later. A shift towards transparency A cascade of changes that led into the new millennium followed. In 2000, Nike joined others to support the United Nations Global Compact, a pact encouraging corporations to report efforts for compliance in facilities and other sustainability practices. In 2001, Nike’s first corporate responsibility report was published. A couple years later, in 2004, Nike formed a panel of external experts to review its corporate responsibility report. Neil Kearney, a member of that panel, argued that Nike wouldn’t be able to earn the recognition it craves from the NGO community without releasing its entire factory database. Finally, in 2005, Nike surprised the industry by releasing a complete list of contractor facilities on its own accord. It was the first disclosure of its kind in the industry. The futureHaving learned from its ethical missteps, Nike has been on the lookout for trends that may generate new risk factors in the future. As an example, Nike recently revamped its sustainability practices in an effort to manage risk and minimize future disruption; one such example is its integration of waterless dye technology into its production process. More generally, Nike is constantly changing its processes and design to achieve a model that reuses waste generated in production. Only time will tell whether or not these efforts will come to fruition [4].
