This trial would be the first legal verdict concerning the payment of network usage fees between a content provider and an ISP. If Netflix is obligated to pay a network usage fee to SKB, how do you see ISPs, customers, and other content providers responding?

2020년 4월, 넷플릭스는 SK 브로드밴드(이하 SKB)를 상대로 소송을 제기했습니다. SKB는 넷플릭스가 자사 인터넷 망의 트레픽을 급증하게 만들어 망 운영에 부담을 줬기 때문에 적정한 사용료를 내야 한다고 주장한 반면 넷플릭스는 콘텐츠 제공자(CP)가 인터넷 서비스 업체(ISP)에게 망 사용료를 내는 것이 망 중립성 원칙에 위배된다는 것을 인정받고자 합니다.

In April of 2020, Netflix filed a lawsuit against SK Broadband (SKB) over network usage fees. SKB responded by arguing that Netflix ought to pay fees, as it has put an undue burden on SKB’s network operation. Netflix wishes for Korean courts to recognize that it is against principles of net neutrality for Content Providers (CPs) to have to pay network fees to Internet Service Providers (ISPs).  What is Net Neutrality? To understand net neutrality, one must first understand the two industries relevant to the issues: ISPs and CPs. ISPs (Internet Service Providers) are companies that provide internet service, such as SKB, KT, or AT&T in the United States. CPs (Content Providers), similarly, are companies that provide information and services for users to consume, such as YouTube or Netflix.  Termed originally by American media jurist and professor Tim Wu of Columbia Law School, net neutrality is the idea that ISPs should treat all network content equally and without discrimination, regardless of how much bandwidth is used. It was introduced in 159 countries as of 2018, and it has quickly become the foundation for the growth of the internet. It encourages companies to create and provide quality content and services for their customers.  Netflix's Growth and Traffic Burden Netflix, which started operating in Korea in January of 2016, has grown rapidly. Starting from 2018, its growth skyrocketed, as Netflix originals, like Kingdom, were immensely [1] popular. The streaming service invested more than $700 million in original content production in the five years following its introduction, and entered partnerships with Korean content producers. Korean producer partnerships, such as those with CJ E&M and Studio Dragon rapidly increased the number of Netflix subscribers in early 2019.  In 2020, Netflix surpassed 3.3 million subscribers in Korea and went on to exceed 10 million subscribers in 2021. Its sales volume is now more than double the sum of the three major Korean OTT companies. As a result of the above, content providers’ share of Korea’s data traffic grew (YouTube to 25%, Netflix to 5%). In response, SKB began requiring Netflix to pay usage fees in 2019.  If the number of Korean users using content services based outside of Korea continues to grow, Korean ISPs would need to increase the bandwidth of their overseas networks for smooth communication. As a result, Korean ISPs are requiring payment from overseas content companies. Netflix, however, refused the charges, arguing that it is the duty of ISPs to transmit data from servers globally, and asserted that demanding compensation from CPs violates the principles of net neutrality. 	Netflix has linked SKB's Internet to its Open Connect Alliance (OCA) in Tokyo, Japan, which then transmits data to Korea. Therefore, Netflix pays access fees to Japanese telecommunication companies. In the same way that individuals whose network traffic passes through other countries are not responsible for paying or managing those countries’ servers, Netflix would pay only an access fee to Japanese telecom companies. Netflix continues to assert that issues related to the bandwidth of transiting traffic are something ISPs should sort out amongst themselves. SKB's position The world wide web [2], also known as the internet, is directly and indirectly connected, similar to a network of roads. Network usage fees, then, are comparable to highway tolls. As SKB has established a highway, CPs like Netflix should be responsible for paying their fair share of tolls, since they bring about a heavy burden on the network (in the form of traffic congestion, device wear, etc.)  SKB’s stance is that its request for payment from Netflix is akin to imposing a levy for road expansion to a new shopping mall, as roads have grown congested as a result of the new mall. While communication networks have the characteristics of a public good, SKB argues that it is in fact private property for which private operators have invested large amounts of money. Netflix refusing to pay, then, is akin to freeriding.  Those who side with SKB question whether net neutrality’s values are well reflected in the current dilemma since a small number of companies seem to dominate web traffic. In their view, imposing data usage fees or slower internet speeds for generating more traffic is in keeping with free-market principles and would protect good-faith players in the market. SKB’s perspective is that it’s not only ISPs but also CPs who profit by using the internet. As a result, CPs must bear the burden of the costs associated with increased traffic. Currently, Korean content providers such as Naver and Kakao are paying tens of billions of won each year to ISPs in Korea, but there is no legal precedent or obligation for their payments. Netflix's Stance Netflix already pays access fees for internet network use to Japanese telecommunication companies. Since data from Japanese Netflix servers enter Korea as transmissions rather than access, which should be guaranteed under net neutrality, it would be unfair to pay any more than the usage fee they’ve already provided to Japanese telecom companies. In fact, ISPs in the US and Europe do not require network usage fees from Korean content providers such as Naver or Kakao that are transmitting data from Korea.  Companies that do business using the internet view the world wide web as public infrastructure. They argue that carriers should neutralize traffic processing for users and in the name of technological innovation. If traffic discrimination is permitted, there are concerns that ISPs would prioritize or deprioritize traffic for their own commercial interests. This poses a serious risk to fair competition.  Furthermore, they assert that if this discrimination is permitted, small companies would be unable to compete with larger corporations. Companies like YouTube, for example, would be able to afford to pay exorbitant [3] amounts to ISPs and ensure only their traffic is prioritized, thereby resulting in slower access to any non-YouTube services.  Ultimately, the question of what is fair when it comes to network usage may be decided by the courts — how this specific case plays out remains to be seen.

SKB는 넷플릭스가 자사 인터넷 망의 트레픽을 급증하게 만들어 망 운영에 부담을 줬기 때문에 적정한 사용료를 내야 한다고 주장해 왔습니다. 반면 넷플릭스는 한국 법원을 통해 콘텐츠 제공자(CP)가 인터넷 서비스 업체(ISP)에게 망 사용료를 내는 것이 망 중립성 원칙에 위배된다는 것을 인정받고자 합니다.   망 중립성이란 무엇인가? 망 중립성을 이해하려면 우선 이와 관련된 두 업계에 대해 이해해야 합니다. 인터넷 서비스 제공자(ISP)는 SKB, KT, 미국의 AT&T 등 인터넷 망을 제공하는 업체입니다. 다른 하나인 콘텐츠 제공자(CP)는 유튜브, 넷플릭스 등 인터넷에서 고객들이 소비할 콘텐츠와 서비스를 제공하는 것이 업체입니다. 망 중립성은 미국 미디어법학자이자 컬럼비아 대학 로스쿨의 Tim Wu 교수에 의해 만들어졌는데, 인터넷 서비스 제공자가 망을 이용하는 모든 콘텐츠를 동등하고 차별없이 다뤄야 한다는 개념입니다. 트래픽을 많이 만들던 적게 만들던 말입니다. 2018년 기준 159개국이 이 개념을 채택했고, 인터넷 관련 사업들이 성장하는데 밑거름이 되었습니다. 망 중립성은 기업들이 다양한 콘텐츠와 서비스를 만들어서 고객들에게 제공할 수 있게 돕습니다.  넷플릭스의 성장과 트래픽 부담 2016년 1월 한국에서 정식 서비스를 시작한 넷플릭스는 한국에서 빠르게 성장했습니다. 2018년 부터는 한국 킹덤 등 오리지널 콘텐츠가 큰 인기를 끌면서 성장세는 하늘을 찌를 듯 했습니다. 한국 진출 이후 약 5년간 7억달러 이상을 오리지널 콘텐츠 제작에 투자하며 한국 콘텐츠 제작사들과 파트너십을 맺었는데, 2019년 초 CJ E&M, 스튜디오 드래곤 같은 한국 제작사들과의 파트너십은  넷플릭스 가입자를 크게 증가시켰습니다.  2020년 한국에서 유료가입자 330만명을 돌파한 넷플릭스는 2021년 월간 유료이용자수가 천만명을 넘어섰습니다. 이 회사의 매출 규모는 한국 OTT 3사를 합친 것보다 2배 이상으로 커졌습니다. 이로 인해 한국의 데이터 트래픽에서 일부 콘텐츠 제공 업체가 차지하는 비중(유튜브 25%, 넷플릭스 5%)이 급증 했습니다. 이에 대응해 SKB는 2019년부터 넷플릭스에게 이용료를 납부할 것을 요구하기 시작했습니다.  넷플릭스 같은 해외 콘텐츠 서비스를 사용하는 국내 사용자가 늘면, 국내 인터넷 서비스 업체들은 원활한 통신을 위해 해외망 대역폭을 늘려야 합니다. 그래서 이 비용을 해외 콘텐츠 업체에게 요구한 것입니다. 그러나 넷플릭스는 해외 서버에서 넘어온 데이터를 전송하는 것은 인터넷 서비스 업체가 수행해야 할 당연한 의무이며, 이에 대한 대가를 콘텐츠 제공업체에게 요구하는 것은 망 중립성에 위배된다며 요구를 받아들이지 않았습니다. 넷플릭스는 일본 도쿄에 있는 자사의 오픈 커넥트 얼라이언스(OCA)에 SKB의 인터넷을 연결해 한국으로 데이터를 전송하고 있습니다. 따라서, 접속료는 일본 통신사에 내고 있습니다. 개인 고객의 트래픽이 다른 나라의 망을 거쳐간다고 해서 고객이 거쳐가는 모든 통신사에 비용을 내지 않는 것처럼, 넷플릭스는 자신의 서버에 직접 접속하는 통신사에만 계약된 접속료를 지급하려 합니다. 넷플릭스는 이런 통과 트래픽에 대한 비용 정산은 인터넷망 업체 간에 해결할 이슈라는 입장입니다.  SKB의 입장 인터넷이라고 알려져 있는 World Wide Web은 자동차 도로망과 같이 직/간접적으로 연결되어 있습니다. 따라서 망 사용료는 고속도로 통행료에 비유해 이야기할 수 있습니다. SKB는 자신이 고속도로를 건설해 놓은 만큼, 그 망에 부담(교통체증, 유지/보수 등)을 가중시키는 넷플릭스와 같은 콘텐츠 제공 업체들이 공정한 요금을 부담해야 한다는 입장입니다.  SKB의 입장은 마치 특정 지역에 새로운 대형 쇼핑몰이 건설되어 인근 지역에 교통체증이 유발될 것이 명확하면 해당 쇼핑몰에 교통유발부담금을 부과하는 것과 유사한 접근입니다. 통신망이 공공재의 성격이 있긴 하지만, 사실은 민간 사업자들이 막대한 자금을 투자한 사유 재산이라는 주장입니다. 따라서, 넷플릭스가 사용료를 내지 않는 것은 무임승차와 다를바 없다는 것입니다.  이 주장에 동의하는 사람들은 소수의 업체들이 데이터 트래픽을 과도하게 점유하고 있는 현 상황이 망 중립성이 추구하는 가치가 현실에 제대로 구현된 것인지에 대해 의문을 제기합니다. 이들의 시각에서 보면, 추가 요금을 부과하거나 속도를 늦추는 등의 차별적인 조치를 취하는 것이 시장 논리에 부합하며, 시장에서 선의의 피해자가 나오지 않게 보호할 수 있다 주장합니다.  SKB는 인터넷 사용 증가에 따른 이익은 인터넷 서비스 업체 뿐 아니라 콘텐츠 서비스 업체들도 함께 누리고 있다고 봅니다. 결과적으로, 콘텐츠 서비스 업체들도 트래픽 증가에 따른 비용을 함께 부담해야 한다는 입장입니다. 실제로 네이버, 카카오 등 한국의 콘텐츠 사업자들은 국내 인터넷 서비스 업체에게 매해 수백억원의 사용료를 지급하고 있습니다. 그러나 이러한 망 사용료를 지급하는 것에 대해서는 사실 아무런 법적인 근거나 의무가 없습니다.  넷플릭스의 주장 넷플릭스는 인터넷망 사용에 대한 접속료를 이미 일본 통신사에 내고 있습니다. 일본 넷플릭스 서버에서 넘어온 데이터가 한국으로 들어가는 것은 접속이 아닌 전송의 범주(망 중립성 원칙 하에서 당연한 의무)에 해당하므로, 넷플릭스는 이미 일본 통신사에게 내는 사용료 외에 추가 요금을 부담하는 것은 부당하다고 주장하고 있는 것입니다. 실제로 미국이나 유럽의 인터넷망 서비스 업체는 네이버나 카카오 같은 한국 내에 서버를 갖고 있는 한국의 콘텐츠 업체에게 별도의 망 사용료를 요구하지 않습니다.  넷플릭스처럼 World Wide Web을 사용하여 사업을 영위하는 기업들은 통신망을 누구나 이용할 수 있는 공공의 인프라로 바라봅니다. 따라서 이들은 기술 혁신과 이용자의 이익을 위해 통신사업자는 트래픽 처리를 중립적으로 해야한다고 주장합니다. 트래픽에 대한 차별을 허용할 경우 통신 사업자가 사업적 이해관계에 따라 일부 트래픽을 먼저 처리하는 등의 부작용이 생길 수 있습니다. 이는 결국 공정한 경쟁을 심각하게 저해할 수 있습니다.  더 나아가 이들은 이런 차별이 허용될 경우 소기업들이 큰기업으로 성장하는 것이 불가능하게 된다고 주장합니다. 예를 들어, 유튜브 같은 업체가 인터넷망 업체에게 막대한 사용료를 지불하면서 훨씬 쾌적한 인터넷 환경을 제공받고, 유튜브가 아닌 업체들의 서비스를 느리게 만들 수도 있는 것입니다.  결국 네트워크 사용과 관련해 무엇이 공정한지에 대한 문제는 법원에서 결정될 것입니다. 이 사례가 어떻게 전개될지는 두고 봐야 합니다.
