Although it sometimes may seem that the President of the United States is ubiquitous [1] in domestic and foreign policy making, they are a mere one-third of the federal government. Indeed, the President leads the executive branch, and works with the legislative and judicial branches to govern. Each branch executes responsibilities critical to the function of the government, and those responsibilities, laid out in the Constitution, are unique to each branch. For one, the judicial branch, represented by the Supreme Court and lower courts, interprets the Constitution and laws passed by the legislature that may contradict it. The legislative branch is a bicameral [2] legislature, split between the House of Representatives, wherein each state’s representation is proportional to their population, and the Senate, composed of 100 members, two from each state. Known collectively as Congress, this branch has the sole power to legislate, or to make laws, which must pass both chambers of Congress. The President, then, is the chief enforcer of laws, and also serves as the head of government and state, meaning country. Both the President and legislature are elected by the people, but the judiciary is filled with presidential appointments that are confirmed by the Senate. Ingrained in the Constitution are ways for each branch to express considerable oversight power over each other through checks and balances. For example, Congress holds impeachment power over the executive branch, which allows them to remove the President from office for “high crimes and misdemeanors.” Additionally, the President can veto [3] laws passed by Congress. The judiciary can rule if a new law is unconstitutional, and therefore strike it from the books. The splitting of the government into separate branches is known as separation of powers, and it ensures that no one branch gets too powerful, or usurps [4] their official responsibilities. The Founding Fathers felt it necessary to establish this three-pronged approach to government after King George III abused his power as British monarch. The 50 states also feature this separation, although the powers of state branches are not always identical to those of the federal government. Separation of powers, and checks and balances are integral to American governance, so much so that controversy ensues when any branch or any person therein seems to encroach on another branch, like when a Supreme Court ruling operates as a law or the President uses executive orders [5] to create rules. The fact that any perceived trespass onto or by any of the branches faces backlash indicates that the separation of powers, and the sanctity of the three branches, are perhaps the most sacred tenets of American democracy.

미국은 때때로 대통령이 국내와 외교 정책 수립을 도맡고 있는 나라처럼 보일 수 있지만, 대통령은 미국연방정부의 3분의 1에 불과합니다. 사실 미국대통령은 행정부의 수반으로 입법부, 사법부와 함께 국정을 수행합니다. 각 부는 정부 기능에 있어 중대한 책무를 수행하며, 헌법에 제시되어 있는 그러한 책무들은 각 부에만 부여된 고유한 것입니다. 우선 대법원과 하위 법원들로 대표되는 사법부는 헌법과 입법부에서 통과되었지만 헌법에 모순될 수 있는 법률을 해석합니다. 입법부는 양원제로, 인구에 비례하여 각 주를 대표하는 하원과 각 주에서 2명씩 모인 총 100명으로 구성되는 상원으로 나뉘어 있습니다. 통틀어 의회라고 알려진 이 입법부는 입법, 즉 법률을 제정하는 유일한 권한을 가지고 있는데 입법이 되려면 반드시 상하 양원을 통과해야 합니다. 대통령은 법 집행의 최고 책임자이고 또한 정부와 국가의 수장 역할을 합니다. 대통령과 입법부의 의원들은 국민에 의해 선출되지만 사법부는 대통령이 임명하고 이를 상원이 인준하여 채워집니다. 각 부는 헌법에 명시된 대로 “견제와 균형”을 통해 서로의 권한을 제한하는 방법을 가지고 있습니다. 예를 들면 의회는 행정부에 대한 탄핵권을 가지고 있어서 “중대범죄와 비행”을 이유로 대통령을 면직할 수 있습니다. 또한 대통령에게는 의회에서 통과된 법에 대한 거부권이 있습니다. 사법부는 새로운 법이 헌법에 위배되는지를 판결할 수 있고 그 결정에 따라 법전에서 이를 삭제할 수 있습니다. 정부를 별개의 세 부분으로 나누는 것은 “삼권분립”이라고 하며 이는 어느 한 부가 지나친 권한을 가지거나 직권을 남용하지 않도록 보장합니다. 미국의 건국자들은 조지 3세가 영국 군주로서 왕권을 남용한 것을 경험하고 삼부로 나뉘어진 정부를 수립해야 할 필요성을 느꼈습니다. 50개 주정부들도 각각 이러한 삼권분립의 특징을 가지고 있으나 주정부의 삼부가 가진 권한들이 연방정부의 그것과 항상 일치하지는 않습니다. 권력의 분산 그리고 견제와 균형은 미국의 통치에 있어서 절대적인 핵심이기 때문에, 어느 한 부나 그 부 소속 사람이 다른 부의 권한을 침해하는 듯이 보이면 논란이 뒤따릅니다. 예를 들어, 대법원의 어떤 판결이 하나의 법으로 작용한다든지 대통령이 규칙을 만들기 위해 행정명령을 사용하는 경우처럼 말입니다. 다른 부의 권한을 부당히 침해하거나 혹은 침해를 당한 것으로 보여지면 곧바로 심한 반발에 직면한다는 사실은, 권력의 분산과 삼부의 존엄성이 미국 민주주의가 지닌 가장 신성한 원칙임을 보여주고 있습니다.
